“Dr. Phil” McGraw had an intense show on Wednesday debating whether there was a correlation between obesity and health problems.

Dr. Phil spoke with a guest and multiple experts about a crisis facing the nation in an episode titled, “Has the Body Positivity Movement Gone Too Far?” Dr. Phil asked his “body positivity” activist guest, “Would you agree that being obese or being morbidly obese puts you at risk for diseases at a higher level than if you were at a lesser weight and everything else was constant?” 

Lexi the activist replied, “I would disagree with you from my personal experience, and from what I know working in the body positivity movement for the past few years, and hearing other people’s accounts.”

Dr. Phil responded with a litany of damning statistics.

And if you have high blood pressure, you’re 200 to 300 percent more at risk for a stroke.”

Lexi claimed, “I have none of those issues. I have no indicators of those issues being anywhere on the horizon. I am perfectly healthy. Even if I weren’t, I’m obviously still entitled to dignity and respect, which is my main pillar of belief and what I talk about most often.”

She then pivoted to target the race and gender of the scientists who have done the research.

“My issue is if somebody that is overweight is out telling people this is not a high risk situation. And I say that because of the science, and it means something to me,” Dr. Phil explained. “Because I’ve buried a nephew that was morbidly obese at 50. I’ve buried a nephew that was morbidly obese in his 40s. I’ve buried two aunts that were morbidly obese in their 40s. My entire family has been morbidly obese, and I’ve buried them all in their 40s and 50s.”

He concluded, “I think it is dangerous for people to be out there saying this is not an at-risk condition. And I do not endorse it.”

The attorney for a Black man serving a virtual life sentence for shootings he committed at 17 has asked the Washington Supreme Court to reconsider a split ruling that upheld his sentence, saying the leniency it granted white defendants in similar situations reveals racial bias.

The court last month upheld the 61-year sentence for Tonelli Anderson, 45, over forceful dissents from four justices.

The decision abandoned a precedent issued just a year earlier in which the court said — in the case of a white defendant — that such lengthy punishments for juvenile killers were unconstitutional because it left them no chance of a meaningful life outside prison.

“When this Court makes decisions reflecting racial bias, it must review and correct them,” Travis Stearns, an attorney with the Washington Appellate Project, wrote in a motion filed last week. “Because this decision reflects such a bias, this Court should reconsider its decision and provide Tonelli with the same relief white litigants who appeared before this Court received.”

On Monday, three civil rights organizations — the Fred T. Korematsu Center for Law and Equality at Seattle University School of Law; the Juvenile Law Center, based in Philadelphia; and Huy, which supports indigenous inmates in the Pacific Northwest — filed a friend-of-the-court brief saying the decision was also wrong because it failed to account for the youthful defendant’s capacity for rehabilitation.

Anderson was 17 when he shot two women, killing one and blinding the other, during a drug robbery in Tukwila in 1994. An accomplice also shot and killed a man at the same home.

Anderson was not immediately arrested, but went on to commit other crimes as a young adult, including assault and robbery, and he wrote letters to girlfriends bragging about the shootings. It wasn’t until 1998, after someone tipped off investigators about the letters, that he was charged.

He was convicted of first-degree murder in 2000 and sentenced to 61 years. Following federal and state rulings that children must be treated differently by the justice system, he was granted a new sentencing hearing in 2018. The judge gave him the same term, finding Anderson had not shown the shootings reflected “transient immaturity.”

In recent years, the Washington Supreme Court has taken further steps restricting what sentences can be imposed on children.

In 2018, the justices held that it violated the state Constitution to sentence 16- or 17-year-olds to life in prison without parole. That ruling came in the case of Brian Bassett, a white man who killed his parents and brother when he was 16. Bassett has since been resentenced to 28 years.

Last September, the court struck down a 46-year sentence for Timothy Haag, a white man who was 17 when he drowned his 7-year-old neighbor. In that case, a six-justice majority held that juvenile murder defendants must be given “a meaningful opportunity to rejoin society after leaving prison.”

Nevertheless, the court last month rejected Anderson’s request for a new sentencing. Justice Debra Stephens wrote for the 5-4 majority that such virtual life sentences for juveniles are barred by the state Constitution only if their crimes “reflect youthful immaturity, impetuosity, or failure to appreciate risks and consequences.”

Anderson’s was not such a case, Stephens said.

The dissenting justices said it was nonsensical that the court would find a 46-year sentence for a white 17-year-old to be an unconstitutional “de facto” life sentence, while upholding a 61-year sentence for a Black 17-year-old.

Justice Mary Yu wrote it would be “willfully oblivious” to conclude race played no role.

“Bassett and Haag are both white. Anderson is Black,” Yu wrote. “Bassett and Haag were both recognized by this court as former juvenile offenders capable of redemption and rehabilitation, and they were ordered to be resentenced accordingly. Anderson has been denied any such recognition and resentencing, contrary to the law and the evidence.”

The King County Prosecutor’s Office, which opposed granting Anderson a new sentence, is due to respond to Anderson’s motion for reconsideration by Oct. 17. The office previously urged the justices to overturn the decisions in the Haag and Bassett cases, saying they were incorrectly decided. Anderson’s youth did not play a significant role in his crimes, it argued.

GOFFSTOWN, N.H. – Gov. Larry Hogan, in his most forceful language to date, charges that the controversial move last month by GOP Gov. Ron DeSantis of Florida to fly migrants from Texas to the progressive bastion of Martha’s Vineyard in Massachusetts was a “terrible idea” and a “publicity stunt.”

“He grabbed 50 people and sent them to Martha’s Vineyard as a publicity stunt and I think I was a terrible idea. Let’s just try to address the issue seriously and fix the problem rather than try to get on TV,” the term-limited Republican governor of blue state Maryland argued as he took questions from the audience during a stop in New Hampshire on Thursday. “It’s not a serious discussion. It’s not a good solution.”

Hogan, who’s mulling a potential bid for the 2024 GOP presidential nomination, made his comments as he headlined the latest edition of “Politics and Eggs.” The speaking series at Saint Anselm College’s New Hampshire Institute of Politics for two decades has been a must stop for potential or actual White House contenders visiting the first-in-the-nation presidential primary state.

The governor claimed the that move by DeSantis was “really was just to get attention, I think. Didn’t solve any problem. There’s tens of thousands of people crossing the border and 50 people dropping off in Martha’s Vineyard, I don’t think is going to fix it.”

Taking a question from Fox News Digital following the event, Hogan noted that he hadn’t talked directly with the Florida governor, and he reiterated that “I just didn’t think that was a smart idea. I thought it was a publicity stunt. And I would tell him that to his face.”

DeSantis, whose popularity has soared among conservatives in Florida and across the country the past two and a half years, courtesy of his forceful pushback against coronavirus pandemic restrictions and his aggressive actions as a culture wars warrior, sparked a new controversy last month with the flying of the migrants to Martha’s Vineyard.

While igniting outrage among Democrats, the calculated move spotlighted the combustible issue of illegal immigration and border security, which fires up the GOP base but also connects with independent voters who may be frustrated with the Biden administration efforts in handling the surge in border crossings into the U.S. over the past year and a half.

DeSantis has repeatedly defended his move and says outrage over the flight was misplaced.

“It’s really frustrating. Millions of people since Biden’s been president, illegally coming across the southern border. Did they freak out about that? No,” DeSantis said last month in an appearance on Fox News’ “Hannity.”

“You’ve had migrants die in the Rio Grande — you had 50 die in Texas in a trailer because they were being neglected. Was there a freakout about that? No, there wasn’t,” DeSantis added.

Pushing back against criticism, the governor’s office said in a statement that “Florida gave them [the migrants] an opportunity to seek greener pastures in a sanctuary jurisdiction that offered greater resources for them.”

Political prognosticators also view DeSantis as a potential 2024 Republican presidential hopeful, and Hogan’s comments could serve as a preview of things to come when the next GOP nomination battle officially gets underway following November’s midterm elections.

“I think we’ve got to secure the border and then find a pathway to citizenship,” Hogan told the audience in New Hampshire. “I did join in with 23 other governors with a border strike force to try and secure the border because I think the federal government is failing in that regard.”

Hogan also said the move by longtime Republican Gov. Greg Abbott of Texas to bus migrants who crossed from Mexico into his state to progressive northern cities “a mistake.” Among the cities where Abbott’s transported the migrants is Washington D.C, which borders Maryland.

Hogan told Fox News that he had a face-to-face conversation with Abbott and told the Texas governor “I don’t think it’s a great idea to be dropping off thousands of people on my state border” and said he asked Abbott to “please stop dropping them off next to us.”

The trip by Hogan to New Hampshire was his third since July, which is sparking more speculation about his national ambitions.

The governor told the audience that when it comes to a potential GOP presidential nomination run, “I think there are 15-20 that are potentially thinking about doing this.”

Asked if there’s room for someone who’s a vocal critic of former President Donald Trump in today’s Republican Party, Hogan said “Is there a lane? I don’t know. That’s part of what we’re trying to find out. I think there are 10 people who want to be the next Donald Trump and I think there may be a different lane.”

Hogan later touted to reporters that “whenever you talk about the five or six people who might be running for president, I’m included in that discussion….. obviously, it’s a longshot and it’s not what everybody’s focused on right now. But the election is two years from now and there’s a lot of things that can change… I think that it’s going to look a lot different than it looks right now.”

HOGAN PREDICTS TRUMP’S SWAY OVER GOP ‘DIMINISHED’

Asked by Fox News about a meeting he held last week with political advisers and top donors, Hogan said “I was updating some of my strongest supporters on exactly where we were,” but added that no decisions about 2024 will come until after his second and final term as governor ends in mid-January.”

But Hogan said he told his donors “that we’ve been to 25 states. We’ve done hundreds of national interviews and we’ve been meeting people everywhere….The crowd was very excited.”

Hogan said he’ll hold a leadership summit he’s holding in late November in Maryland with thought leaders from around the country together to try to talk about the path forward and what we can do to get the country moving in a different direction.”

“We’re all going to gather at the end of November and try to figure out what the path forward is the for the country and what my potential future might be,” he told Fox News.

A Pittsburgh restaurant owner blamed COVID Wednesday after he was forced to close his doors due to a persistent labor shortage and other economic woes rooted in the pandemic. 

Cafe Raymond owner Ray Mikesell joined “America’s Newsroom” to discuss the issues he has faced and why he has decided to close his business as a result. 

“They just beat you down, so much that… I don’t have the fight to fight them anymore and try to stay open and hire people,” Mikesell told co-host Dana Perino. “It’s been… almost three years, and I just don’t have it in me anymore at this point in my life. I have a passion for what I do, but I just want to I don’t want to do it this way no more.”

Mikesell blames the pandemic for many of the struggles he faces today as a business owner, citing struggles with the labor shortage all while demand continues to surge. 

“It changed the world, the work ethic for everybody, a lot of young people,” Mikesell said. “I pull my hair out, I can’t hire anybody. It doesn’t matter what you’re paying them or anything of the sort… anybody I do hire, they quit in two days.”

“A lot of people think that I’m not busy,” he continued. “I’m busier than we have ever been with a third of the staff, and there’s times that I have to close down while we’re open in prime business hours. I closed for 20 minutes because we’re out of plates, silverware, everything, coffee cups.”

Mikesell said he will relocate his business to Montana in hopes of finding a new beginning for himself and his family. 

“I get upset when I talk about it because I got my life invested in this,” Mikesell said. “But it is at this level, it’s not worth it. It just goes upon deaf ears when you talk to people.”
