Senate Judiciary Committee member Lindsey Graham said Wednesday it will “hurt the country” if Attorney General Merrick Garland does not take swift, equitable action in light of classified documents being found in a University of Pennsylvania-linked office previously used by President Biden.

Graham told Fox News a special counsel should be promptly appointed to investigate the matter with the same tenacity that Garland sought to probe President Donald Trump following the discovery of classified material at Mar-a-Lago in Palm Beach. Following Graham’s interview, Fox News confirmed that aides to Biden discovered at least one more batch of classified documents from his time as vice president in Biden’s possession.

Reacting to what he called a ridiculous response by White House press secretary Karine Jean-Pierre to Fox News’ Peter Doocy’s questions, the South Carolina senator said many Americans are “disgusted with the standard that exists in America when it comes to conservatives and everybody else.”

“So what I think if you believe a special counsel is necessary to assure the public about the handling of classified documents by Donald Trump, you should apply special counsel to the mishandling of classified documents by President Biden when he was vice president,” he said.

Failure to do so, Graham said, will damage the republic and reinforce the one-sided media narrative that when Democrats do something Republicans are punished or investigated for, it is acceptable.

Graham referenced the fact Clinton National Security Adviser, Sandy Berger pleaded guilty in 2005 to knowingly removing classified information from the National Archives — and received probation, a fine and surrender of his security clearance – according to an announcement at the time from then-Assistant Attorney General Christopher Wray, who is currently FBI director.

The documents had to do with the Millennium Attacks terror plot, which was foiled in part after an Al-Qaeda-trained Algerian was detained debarking an international ferry at Port Angeles, Washington in 1999 with explosives purportedly meant to be used at LAX on New Year’s Eve.

“General [David] Petraeus was prosecuted for turning over classified information [to a reporter]… He made a mistake, but he was actually prosecuted… Sandy Berger put classified information in his socks. So, yes, but here’s what I believe when it comes to presidents, the idea of prosecuting a president regarding this handling classified information is very problematic because they have the right to declassify,” Graham said.

“If there’s not a special counsel appointed to find out how this happened with President Biden regarding classified information, there is going to be a lot of angst — It will hurt the country,” he added.

“Garland If you’re listening, if you thought it was necessary, attorney general, to appoint a special counsel regarding President Trump, then you need to do the exact same thing regarding President Biden when it comes to handling classified information.”

“Sandy Berger put classified information in his socks. So, yes — but here’s what I believe when it comes to presidents, the idea of prosecuting a president regarding this handling classified information is very problematic because they have the right to declassify.”

Following the raid on his estate last year, Trump also called for what he considered equal application of justice, pointing to how conservative watchdog Judicial Watch was denied by a judge in its attempt to obtain access to audiotapes President Clinton had kept in his sock drawer.

Frankie Muniz is suiting up.

No, he’s not donning a Superman cape or going to turn green like the Incredible Hulk. Muniz will be putting a helmet and a fire suit on and stepping into a stock car for the 2023 ARCA Menards Series.

The “Malcolm in the Middle” star will race the No. 30 Ford Mustang for Rette Jones Racing beginning at Daytona International Speedway on Feb. 18. It will be complete a lifelong dream come true for Muniz.

Nearly every House Democrat Wednesday voted against legislation that would require immediate medical attention for babies who are born alive after an attempt was made to abort them.

The House passed the Born-Alive Abortion Survivors Protection Act, which says any infant born alive after an attempted abortion is a “legal person for all purposes under the laws of the United States.” Doctors would be required to care for those infants as a “reasonably diligent and conscientious health care practitioner would render to any other child born alive.”

The bill passed 220-210, and all 210 of the “no” votes came from Democrats.

Following that level of care, doctors would be required admit those infants to a hospital for further care. Any violation of this standard would result in fines and imprisonment for up to five years, or both.

Republicans argued on the floor that comments from Virginia’s former Democratic Gov. Ralph Northam are an example of why the law needs to be clarified to protect newborn infants who survive abortions. Northam was talking about third-trimester abortions and appeared to indicate support for delivering babies that might still be alive before taking their life outside the womb.

“We all know in 2019, then-Gov. Northam of the state of Virginia stated this: ‘The infant would be delivered, the infant would be kept comfortable, the infant would be resuscitated if that’s what the mother and the family desired, and then a discussion would ensue between the physicians and the mother,’” said Rep. Jim Jordan, R-Ohio.

“The cavalier attitude he displayed towards human life is just wrong,” Jordan said. “It is simple. Infants born alive following an abortion are kids, are children. All newborns deserve the same level of care.”

Nonetheless, Democrats overwhelmingly rejected the bill. Some, like Rep. Jerry Nadler, D-N.Y., argued that the bill would set up new requirements that would “directly interfere with the doctors’ medical judgment and dictate a medical standard of care that may not be appropriate in all circumstances.”

He and other Democrats said the requirement to eventually take infants who survive abortion to a hospital may not be in the best interest of the family.

Several others rejected Republicans’ stated purpose for bringing up the bill and accused the GOP of trying to outlaw abortion, although the bill places no new limit on abortion.

House Minority Leader Hakeem Jeffries, D-N.Y., accused Republicans of bringing up the bill “as part of your march to criminalize abortion care, to impose a nationwide ban, to set into motion government-mandated pregnancies.”

Rep. Suzanne Bonamici, D-Ore., also cast the bill as an attempt to ban abortion, and said it is “extremist, dangerous and unnecessary.”

Rep. Mary Scanlon, D-Pa., said she opposes the GOP’s “grotesque attempt to politicize abortion care and criminalize doctors.”

Some Democrats said the bill is unnecessary because it is already illegal to kill newborn infants, but Republicans accused Democrats of opposing the legislation to further their radical agenda of abortion on demand.

“Taking the life of unborn children right up to their birthday, and then as Gov. Northam has pointed out, even after that,” Jordan said. “We want to make sure that ‘even after that’ part never happens.”

“I find it absurd, I find it unconscionable that this would be a matter of discussion on this body, that we would not render medical aid to the most innocent amongst us, an unborn child that is born alive after the most traumatic circumstances possible,” said. Rep. Derrick Van Orden, R-Wis.

“This is not about a woman’s access to abortion,” he said. “This is about the sanctity of life and the basic dignity of a human child.”

House passage of the bill sends it to the Democrat-controlled Senate, which is unlikely to act on it.

COHASSET, Mass. – One of the last people to see missing Massachusetts mom Ana Walshe before she vanished has shed light on the woman’s final hours and his suspicions “that there may have been foul play,” according to a recent report.

Gem Mutlu rang in the New Year with Brian and Ana Walshe at their home in Cohasset, Massachusetts, and last saw the woman, a friend whom he’d met through her husband, when he hugged her goodbye around 1:30 a.m. on Jan. 1.

“We hugged and celebrated and we toasted, just what you do over New Year’s,” Mutlu told local news station WBZ-TV. “There was a lot of looking forward to the new year. There was no indication of anything other than celebrating the new year, problems on hold.”

Mutlu declined to comment when contacted by Fox News Digital on Tuesday, and said he was working with a spiritual healer in the wake of his friend’s continued disappearance.

Speaking to WBZ, Mutlu said he and the Walshe family had a “festive” New Year’s Eve that consisted of an “elaborate meal” that Brian cooked.

He recalled how Ana Walshe was “texting with friends” and “sitting next to me at the barstool at their kitchen.”

Walshe, a mother of three young boys, was last seen in the early morning hours of Jan. 1, when she was supposed to take a ride-share service to a local airport to board a flight bound for Washington, D.C.

The Tishman Speyer real estate executive was previously scheduled to depart for D.C. on Jan. 3, but allegedly said there was an emergency that required she fly there earlier than expected.

Her company reported her missing to police on Jan. 4, after, according to Brian Walshe’s defense attorney, he had contacted the firm asking about Ana’s whereabouts.

But in the days between Ana’s disappearance and the missing person’s report, Brian Walshe allegedly lied about his own whereabouts. Investigators said Walshe told investigators he traveled to stores, such as CVS and Whole Foods, where he might not have actually been.

But he allegedly neglected to mention that he spent about $450 in cash buying cleaning supplies from a Rockland, Massachusetts, Home Depot store.

According to court documents and officials, Walshe was spotted on surveillance video “wearing a black surgical mask, blue surgical gloves and making a cash purchase” of items including mops, tape and drop cloths.

Investigators also discovered blood and a bloody, damaged knife in the basement of the couple’s home, and traced Ana’s cell phone to the area of the family’s Cohasset home on Jan. 1 and Jan. 2. Meanwhile, Brian’s cell phone pinged in other parts of Massachusetts, such as Brockton and Abington, despite his lack of permission to be in the areas under the terms of his home confinement.

On Tuesday, officials revealed investigators had recovered even more evidence related to their search for Walshe. They also appeared to have removed – and then replaced – a dumpster taken from Brian Walshe’s mother’s Swampscott home, located nearly 35 miles away from the couple’s residence.

Brian Walshe was arrested on Sunday and charged with misleading a police investigation.

Police said the charge stemmed from Walshe’s alleged “intentional, willful, and direct responses to questions about his whereabouts on the days of Sunday, January 1, 2023 and Monday, January 2, 2023.” They further called it, “a clear attempt to mislead and delay investigators.”

Walshe’s defense attorney, Tracey Miner, argued that her client was otherwise forthcoming with authorities, but neglected to mention his trip to Home Depot. She noted that he had been “incredibly cooperative.”

Walshe, a previously convicted art fraudster, was ordered held on $500,000 cash bail over $5 million surety bond.

Mutlu told WBZ Ana and Brian Walshe, 46, have been “individually and together very impactful on my life.

“My biggest fear had shifted towards the children,” Mutlu said. “I wondered if the children were safe.”

A spokesperson for the Massachusetts Department of Children and Families told Fox News Digital on Tuesday that the couple’s three children were in the custody of the state, but would not provide additional details.
