A lawsuit recently filed alleges that a transgender woman was housed with men in Baltimore, Maryland state-run jail for three months and sexually assaulted at knifepoint and denied her hormone treatment six months prior to her assault trial. 

In her lawsuit, Chelsea Gilliam said her 14th amendment constitutional rights were violated, claiming that the Maryland correctional institutions discriminated against her due to her gender identity. Lawyers have called for compensatory and punitive damages after dependents caused Gilliam “pain and suffering, emotional, psychological, and physical distress and violation of dignity.”

“When you become incarcerated, you not only lose your freedom, but you lose your dignity and your sense of self,” Gilliam said during a news conference Wednesday alongside her attorney. “I was treated like an alien … by inmates and staff — a local joke, day in and day out.”

Initially arrested on an assault charge in December 2021, Gilliam was repeatedly held without bail pending trial, according to online court records. She spent nearly six months incarcerated in a male prison before she pleaded guilty and was released on probation.

Between Dec. 17, 2021, and May 13, 2022, Gilliam, a biological male, claimed that she was forced to live and shower with male inmates during her first three months at the Baltimore City Correctional Center (BCCC). Gilliam said she was sexually assaulted and denied her hormone treatments.

MARYLAND PRISONS FACE SEVERE STAFFING SHORTAGE

“I would say I was treated like an animal, but it was worse than that. People love and respect their animals, Gilliam told WBAL. “I was treated like an alien from the moment I entered Baltimore City Corrections, by inmates and staff.”

According to the lawsuit, Gilliam was diagnosed with and began treatment for gender dysphoria in 2003. Since her diagnosis, Gilliam received hormonal treatment for the past 18 years. She legally changed her name to Chelsea in 2009 and has identified as a woman since she was 17 years old. 

During her time at BCCC, Gilliam alleges that she was denied hormone treatment, which had immediate physical and mental effects, according to the lawsuit.

According to the lawsuit, Gilliam was housed with men at the correctional center and consistently misgendered by staff. She was forced to live and shower with male inmates, “despite the known risk of sexual assault from male inmates and in contravention of” the corrections department’s policy.

Though transgender prisoners are supposed to have access to separate showers, Gilliam was forced to undress in public. She started avoiding the showers after a male prisoner sexually propositioned her; he later threatened her life and sexually assaulted her at knifepoint, the complaint says.

Eventually, staff promised Gilliam accommodation including private showering and recreational time however, the promise was in name only and staff “refused to honor those accommodations.” 

In her experience, Gilliam said, asking to be transferred into a women’s facility was futile. Guards would simply respond: “You are a man, and you are in jail,” she wrote in the complaint.

All this occurred before she had even been convicted of a crime, her attorney Eve Hill said.

Gilliam was then transferred to the Maryland Reception, Diagnostic and Classification Center for three months where she claimed she was kept in solitary confinement because of her gender identity and shackled with a three-piece shackle any time she left he solitary confinement cell despite “having no write-ups or disciplinary infractions.”

The lawsuit alleges that Gilliam was rarely let out of her solitary confinement cell. Throughout the week, Gilliam was let out of the cell one hour per day on weekdays and not let out at all on weekends.

“It’s like they wanted me to pay for being trans. That’s what it felt like,” she said.

The lawsuit alleges that the two correctional facilities that Gilliam was held in had clear standards to govern the treatment of transgendered inmates. The lawsuit cites the Defendant Department of Public Safety and Correctional Services (DPSCS) stating that they are required to allow transgendered inmates to shower separately, continue hormonal treatment, and be assigned a facility based on a case-by-case basis.

The lawsuit names Carolyn Scruggs, secretary of the Maryland Department of Public Safety and Correctional Services, as a defendant in addition to other department employees, including the wardens of both facilities.

Gilliam’s case presents the latest example of transgender inmates suffering the consequences of a system that refuses to respect their rights, her attorney Eve Hill said at the news conference.

Across the country, transgender inmates are often incarcerated in facilities based on their sex assigned at birth, not their gender identity. Advocates say this is dangerous, particularly for transgender women held in custody with men.

States across the country are taking the lead in keeping biological males out of girls’ sports with a flurry of recent legislation while President Biden’s White House at the federal level slams such measures as “discrimination” against transgender students.

North Carolina on Tuesday took a step closer to joining a growing number of states in banning transgender student athletes from playing on teams that align with their gender identity, requiring them instead to compete against those with the same biological sex.

The state Senate advanced out of its Education Committee the Fairness in Women’s Sports Act, which would require athletes to play on teams that match their sex as determined by “reproductive biology and genetics at birth.” 

North Carolina’s House is pursuing its own version of the same bill to make transgender athletes play on sports teams associated with their sex. A similar measure introduced this month would prevent the “male sex” from participating in “interscholastic athletic activities designated for females, women, or girls.”

BIDEN TO VETO GOP BILL PROTECTING WOMEN’S SPORTS, CALLS IT ‘DISCRIMINATION’ AGAINST TRANSGENDER STUDENTS

Republicans in both chambers now hold a veto-proof supermajority thanks to a recent high-profile defection of a Democratic legislator, meaning the bills could potentially become law even if Democratic Gov. Roy Cooper opposes them.

North Carolina is hardly alone. At least 21 states have now imposed restrictions on transgender athletes, primarily with the intention of protecting girls by prohibiting biological males who identify as female from competing against them. And many additional states may soon join that list or expand their restrictions.

The Alabama House of Representatives on Tuesday passed a bill that would ban transgender athletes from participating in collegiate sports, extending a 2021 measure in the state that applied to K-12 sports teams.

“Forcing women to compete against biological men would reverse decades of progress women have made for equal opportunity in athletics,” Republican state Rep. Susan DuBose, the bill’s sponsor, told fellow lawmakers, arguing that “no amount of hormone therapy can undo” physical advantages.

The bill states that sports teams “designated for females, women, or girls shall not be open to a biological male,” and that a “biological female” would similarly not be allowed to participate on teams for boys and men. The legislation now moves to the Alabama Senate, where it will likely pass.

GOP MOVES TO ‘SAVE WOMEN’S SPORTS’: BILL BACKED BY RILEY GAINES HEADED FOR HOUSE VOTE

One day earlier in Missouri, the state House passed its own version of a bill prohibiting transgender athletes from competing according to their gender identity.

The Senate approved similar legislation last month. Each chambers’ bill extends through college athletics, including in Missouri’s private universities. However, while the House bill begins at grade six, the Senate version applies for any grade level.

Last week, North Dakota’s Republican Gov. Doug Burgum signed into law a measure prohibiting transgender girls and women from joining female sports teams in K-12 and college. About a week earlier, the Kansas Legislature overrode Democratic Gov. Laura Kelly’s veto banning transgender athletes from girls’ and women’s sports. And two weeks before that, a similar measure preventing “students of the male sex from competing on a team designated for students of the female sex” became law in Wyoming.

Despite the momentum at the state level, however, don’t expect the federal government to follow suit.

The White House vowed Monday that President Biden will veto a Republican-backed bill that would prevent biological males from participating in women’s sports should it pass both houses of Congress.

Rep. Greg Steube, R-Fla., introduced the Protection of Women and Girls in Sports Act, or H.R. 734, which is expected to come to a vote on the House floor sometime this week. 

“The administration strongly opposes House passage of H.R. 734,” the White House said in a statement. “For students nationwide, participating in sports and being part of a team is an important part of growing up, staying engaged in school, and learning leadership and life skills. H.R. 734 would deny access to sports for many families by establishing an absolute ban on transgender students — even those as young as elementary schoolers — playing on a team consistent with their gender identity.” 

“Schools, coaches, and athletic associations around the country are already working with families to develop participation rules that are fair and that take into account particular sports, grade levels, and levels of competition,” the White House statement continued. “As a national ban that does not account for competitiveness or grade level, H.R. 734 targets people for who they are and therefore is discriminatory.” 

Earlier this month, the Biden administration proposed a new rule that bars outright blanket bans of trans athletes from competing on sports teams that match their gender identity.

The proposal, which must undergo a period of public comment, would prohibit states or school districts from enacting one-size-fits-all policies that “categorically” impose such bans. However, it leaves some wiggle room to limit transgender athletes’ participation in sports if it’s deemed to undermine competitive fairness. The proposal also allows restrictions relating to “important educational objectives” like reducing the risk of injuries.

Pro-trans and LGBTQ advocates argue the administration’s rule is too restrictive and creates guidelines for schools to legally ban transgender athletes. 

Beyond athletics, state lawmakers nationwide have been pushing a number of bills affecting transgender individuals. Indeed, this year alone legislators have introduced more than 400 such bills, dwarfing numbers from recent years. Many of these measures, especially those placing restrictions on gender transition procedures for children and the teaching of gender identity in the classroom, have triggered protests across the country.

In Montana, state Democratic Rep. Zooey Zephyr — the state’s first and only openly transgender legislator — said Tuesday there will be “blood on your hands” if a bill banning certain gender transition procedures on minors is approved by the state House.

Meanwhile, some lawsuits have been filed to challenge state laws restricting the participation of transgender athletes.

In Arizona, parents of two transgender girls filed a lawsuit on Tuesday challenging a year-old state law banning trans girls from participating in school sports, arguing the measure is damaging to then psychologically and denies them equal treatment under the law.

The next day in Ohio, trans athletes and LGBTQ advocates spoke against a House bill, the Save Women’s Sports Act, which would ban biological males from competing in female athletics.

A Florida teacher who allegedly said she wanted to “shoot some students” may have been mentally ill, according to court documents.

Ashlee Renczkowski, a teacher at Fox Chapel Middle School in Spring Hill, Florida, allegedly told a guidance counselor March 24 that she wanted to “shoot some students due to them not performing to their ability,” according to an incident report.

The comments were made after a discussion with the school’s assistant principal where Renczkowski said she was having “bad thoughts.”

Renczkowski, who was born a male, but is in the process of transitioning to a female, told the guidance counselor that she was upset because “learned about a social media post where people were talking negatively about [Renczkowski’s] sexual orientation,” according to the incident report. 

Police said in the incident report that Renczkowski is taking hormone medication and “is planning on having surgery over the summer.”

FLORIDA TEACHER ALLOWED TO WORK FOR WEEKS AFTER ALLEGEDLY SAYING SHE ‘WANTED TO SHOOT SOME STUDENTS’

During the conversation, the teacher also said she has “three handguns at home.”

After Renczkowski made the comments, she “immediately stated she would never harm a student” and “stated that she does not want to harm herself,” the sheriff’s report states. She later went on to say how 

The Hernando County Sheriff’s Office also filed a Risk Protection Order against the teacher in court, which was approved.

According to the Risk Protection Order, the court received evidence that Renczkowski “engaged in a recent act or threat of violence against themselves or others,” “may be seriously mentally ill or may have recurring mental health issues,” and “has used, or threatened to use, against themselves or others.”

The incident report states that three handguns and ammunition were taken out of the teacher’s home, adding that Renczkowski was on medication for depression at the time of the incident.

During a public meeting April 11, administrators said Renczkowski was initially cleared to return to the classroom.

A Hernando County School District spokesperson said that “a threat assessment protocol was followed.”

“What the report shows is that a team of professionals made up of school, district and law enforcement personnel followed all steps of the district’s threat assessment protocol to ensure this teacher was no danger to themselves or others,” the spokesperson said Wednesday.

In a statement released April 13, the school district said Renczkowski will be removed from “all student contact,” adding that a return date will be determined based on an investigation.

“This week, the Hernando County Sheriff’s Office released more information regarding the incident involving a comment made by a Fox Chapel Middle School teacher on March 24th. As part of that release details, not previously known by the school district, appear in conflict with information gathered at the time of the incident,” John Stratton, superintendent of schools, said in a statement. 

“In light of this additional information, the school district will continue to investigate the incident and require further involvement by mental health experts. As part of our investigation, we will take a hard look at all the actions that were taken on that day, and in the days following the incident, and determine if any steps were missed,” Stratton said.

In metro Georgia, police are reporting that gang membership is growing, especially among the very young. Again, gangs have been around for most of our country’s history. We all know that. But we’re seeing something different. It’s much more vicious and it seems more calculated.

A free-for-all, and permissive attitudes toward crime and liberal enclaves? That’s given gangs the incentive to use younger kids to commit some of the worst acts of violence. That’s new. The gangs are also getting more sophisticated in their recruiting, even using social media disguising themselves as public interest organizations. So in a nation facing recession, criminal gangs are now a growth industry.
