John Anthony Castro, a long-shot Republican presidential candidate vying to have former President Trump removed from the ballot over the 14th Amendment insurrection clause, was arrested on federal tax fraud charges Tuesday – a day after a federal judge in Nevada threw out one of his lawsuits aiming to bar Trump from running. 

Castro, 40, of Mansfield, Texas, was indicted on 33 counts of aiding and assisting in the preparation and presentation of a false and fraudulent return, U.S. Attorney for the Northern District of Texas Leigha Simonton announced on Wednesday. Court records show the indictment was filed under seal on Jan. 3.

Prosecutors say Castro carried out a pattern of falsely creating and submitting tax returns on behalf of dozens of unsuspecting taxpayers through his tax prep business, resulting in hundreds of thousands of improperly paid claims. He was arrested Tuesday and released later that day after making his initial appearance before U.S. Magistrate Judge Hal R. Ray, Jr.

“Mr. Castro’s alleged crimes are stunning in their brazenness,” Simonton, who was nominated by President Biden, said in a statement. “The Department of Justice will continue to hold people accountable who steal from the federal government’s – and the American public’s – pockets.”

“This is precisely the type of conduct IRS Criminal Investigation and our law enforcement partners are committed to deterring,” Tammy Tomlins, special agent in charge of the Newark field office added. “Today’s indictment sends a clear message, you will be held accountable if you abuse our tax system for your personal financial gain.”

Castro told the New York Times in a phone interview he believes the indictment was politically motivated and came as an attempt to disrupt his lawsuits challenging Trump’s eligibility. 

“They sat on it for three years to see if I would stop being a problem, politically, and go away, and I didn’t,” Castro told the Times. 

Castro also reportedly told The Hill his firm settled the tax return matter with the IRS in 2021 and alleged that certain clients misinterpreted tax law.

The indictment was announced after U.S. District Court Judge Gloria M. Navarro, of Nevada, issued an order Monday ruling that Castro lacked standing and dismissed his lawsuit that had ultimately asked if the U.S. Constitution’s 14th Amendment bars Trump from holding office over his alleged incitement of the 2021 riot at the U.S. Capitol. 

Navarro, an appointee of former President Obama, had ruled that Castro failed to demonstrate he “suffered a concrete, particularized, and actual or imminent injury” due to Trump’s conduct, and therefore the court lacked jurisdiction on such a “politically charged question of significant interest to the American public.” 

The judge also noted how, by his own admission, Castro declared as a candidate and paid the filing fee to show the impermissibility of Trump’s presidency. Five other courts had already rejected Castro’s political competitor standing argument, and Navarro highlighted that Trump and Castro are not even competing on the same ballot in Nevada. 

SUPREME COURT TO DECIDE IF TRUMP BANNED FROM COLORADO BALLOT IN HISTORIC CASE

According to the indictment, Castro owned and operated Castro & Company LLC., a virtual tax preparation business with locations in Orlando, Florida, Mansfield, Texas, and Washington, D.C. Starting in 2016, prosecutors allege, Castro devised a scheme to falsely create and submit false tax returns on behalf of unsuspecting taxpayers. Taxpayers would seek out Castro’s assistance in filing personal tax returns and Castro would promise a significantly higher refund than taxpayers could receive from other preparers and on many occasions offered to split the additional refund with taxpayers, the indictment says. In order to achieve these larger refunds, Castro allegedly generated false deductions without the taxpayer’s knowledge.

In 2018, an undercover agent, posing as a taxpayer, contacted Castro & Company for assistance, according to the indictment. Castro allegedly refused to meet in person unless a $5,000 retainer was paid but offered to assist the undercover agent virtually. During a recorded telephone conversation, prosecutors allege Castro stated he could project the amount of the tax refund the undercover agent would likely receive from another firm and then compare that figure with the refund that Castro would obtain.

According to the indictment, an employee of Castro’s interviewed the agent over the telephone regarding deductions. 

The employee is said to have stated that Castro would make any decisions regarding what items would be included on the tax filing. The employee did not identify any deductions that would apply to the agent and in the course of the interview, the undercover agent denied any facts that would support deductions, prosecutors say. 

On March 14, 2018, Castro filed the agent’s tax return claiming $29,339 in fraudulent deductions. The IRS issued a refund of $6,007, Castro received $2,999 for his services and the agent received the remaining amount of $3,008. As Castro told the taxpayer, he would have received only a $300 deduction had he used another tax prepare, the indictment notes.

If convicted on all counts, he faces up to 99 years in federal prison – three years per count. The Internal Revenue Service, Criminal Investigation conducted the investigation.

Though Castro’s legal efforts to ban Trump from the ballot have so far been unsuccessful, dozens of other lawsuits are challenging Trump’s eligibility and the Colorado Supreme Court cited the 14th Amendment in removing Trump from the ballot in their state. Maine’s Democratic secretary of state also banned Trump from the ballot, citing the insurrection clause. 

The U.S. Supreme Court agreed to take up Trump’s challenge to the Colorado ruling and is set to hear arguments in February.

Jodie Foster has been making some bold comments recently.

The actress, 61, has been acting steadily since she was 3 years old. Because of this, she was something of a veteran by the time she filmed “Taxi Driver” with Robert De Niro and Martin Scorsese. 

Though she was only 12 years old when she made the movie, she says now her experience scared them.

“I first worked with Martin Scorsese when I was about 10 on ‘Alice Doesn’t Live Here Anymore,'” she said in a new interview with W magazine. “By the time I was 12, I’d made a lot more films than De Niro or Scorsese.

Foster played a child prostitute in the 1976 drama. De Niro was 31 during filming, and he’d been acting for around a decade. Scorsese had directed seven full-length films and a number of shorts.

Although she has had a successful career from a young age, it struck many as odd that she’d say De Niro and Scorsese, who have been successful for decades, would be “scared” of her in that sense.

More comments she’s made recently have been raising some eyebrows too. In an interview last week with The Guardian, she shared some critical thoughts about Gen Z.

“They’re really annoying, especially in the workplace,” she complained. “They’re like, ‘Nah, I’m not feeling it today, I’m gonna come in at 10:30 a.m.’ Or, like, in emails, I’ll tell them this is all grammatically incorrect. Did you not check your spelling? And they’re like, ‘Why would I do that, isn’t that kind of limiting?’”

“And there was a moment with my older one when he was in high school, when, because he was raised by two women — three women — it was like he was trying to figure out what it was to be a boy. And he watched television and came to the conclusion, ‘Oh, I just need to be an a——. I understand! I need to be s—– to women, and act like I’m a f—–.’

Former Ambassador Nikki Haley responded to a Trump attorney’s defense of his immunity from legal charges as president as “ridiculous” during the last GOP presidential debate before the Iowa caucuses. 

Do you agree with the argument Donald Trump’s lawyer made in court that a president should have immunity for any conduct, including in ordering the assassination of a political rival unless that president is impeached and convicted by the Senate for that offense first?” CNN’s Jake Tapper asked Haley during a debate on Wednesday night. 

No, that’s ridiculous,” Haley responded. “That’s absolutely ridiculous. I mean, we need to use some common sense here. You can’t go and kill a political rival and then claim, you know, immunity from a president. I think we have to start doing things that are right and you know Ron said we should have leaders that we can look up to. Well, then stop lying, because nobody’s going to want to look up to you if you’re lying.

Haley continued, “But what I do think we need to look at is what has President Trump done? You look at the last few years and our country is completely divided. It’s divided over extremes. It’s divided over hatred. It’s divided over the fact that people think that if someone doesn’t agree with you that they’re bad. And now we have leaders in our country that decide who’s good and who’s bad, who’s right, and who’s wrong, that’s not what a leader does. What a leader does is they bring out the best in people and get them to see the way forward.

HALEY, DESANTIS FIRE SHOTS AT TRUMP IN HEAD-TO-HEAD DEBATE: ‘HE DID NOT DELIVER’

The question from Tapper to Haley was in reference to a comment from Trump lawyer D. John Sauer this week in a Washington D.C. courtroom where he answered with a “qualified yes” when asked if Trump’s immunity from prosecution as president would apply if Trump “ordered S.E.A.L. Team 6 to assassinate a political rival.”

“He would have to be impeached and convicted,” Sauer argued.

Sauer said, “There’s a political process that would have to occur under the structure of our Constitution which would require conviction and impeachment by the Senate in these exceptional cases, as the OLC memo itself points out from the Department of Justice you’d expect a speedy impeachment and conviction.”

Sauer argued before a federal appeals court Tuesday that the president has “absolute immunity,” even after leaving office — an argument that the judges appeared to be skeptical of.

Judge Karen Henderson, an appointee of former President George H.W. Bush, fired back, saying: “I think it’s paradoxical to say that his constitutional duty to take care that the laws be faithfully executed allows him to violate criminal law.” 

But Sauer argued that Biden, “the current incumbent of the presidency is prosecuting his number one political opponent and his greatest electoral threat.”

Meanwhile, Special Counsel Jack Smith’s team argued that presidents are not entitled to absolute immunity and that Trump’s alleged actions following the November 2020 election fall outside a president’s official job duties.

“The president has a unique constitutional role but he is not above the law. Separation of powers principles, constitutional text, history, precedent and immunity doctrines all point to the conclusion that a former president enjoys no immunity from prosecution,” prosecutor James Pearce said, adding that a case in which a former president is alleged to have sought to overturn an election “is not the place to recognize some novel form of immunity.”

Fox News Digital reached out to the Trump campaign for comment but did not immediately receive a response.

New England Patriots offensive lineman Trent Brown appeared to be unhappy for a good part of the 2023 season as the team fell into the bottom barrel of the NFL.

Before Brown left the Patriots’ facility for the season, he strongly pushed back on the negative reports that swirled around him over the course of the year. Brown took issue with “anonymous sources” leaking information and denied ever speaking about wanting to join an NFC East team.

“It’s been a rough year,” he told NESN in an interview published Tuesday. “This has been a year like no other that I’ve had in my NFL career as far as the amount of anonymous sources that have come forward to spew complete lies about my character.

“It’s been tough to even go in the building every day knowing that there’s somebody that I probably look at every day, or smiles in my face every day, that is running a smear campaign.”

Brown touched on the Patriots’ struggles, pointing to the departure of Ted Karras, the trade of Shaq Mason and the lack of doing anything to fill the position with the right guys as an issue. He added that he felt as though the Patriots were messing with him during the year.

“I’ve even heard from coaches how they’ll sit in staff meetings and they’ll be talking about how they can f— with me,” he said. “Like, I guess trying to get me out of character or whatever. It’s really crazy to think that we’re spending time talking about that instead of getting better.”

New England is going to have a lot of decisions to make, starting with the front office and down.
